Ai nuk mund t\u00eb udh\u00ebhiqet nga logjika e d\u00ebshirave apo protagonizmit individual apo institucional, as nga ngjarje dhe objektiva momental apo te p\u00ebrkohsh\u00ebm, por nga nevoja p\u00ebr t\u00eb krijuar nj\u00eb instrument q\u00eb t\u00eb q\u00ebndroj\u00eb n\u00eb koh\u00eb dhe t\u00eb mb\u00ebshtes\u00eb zhvillimin e shtetit t\u00eb s\u00eb drejt\u00ebs p\u00ebr dekada. Ky diskutim nuk duhet par\u00eb si kund\u00ebrshtim ndaj reform\u00ebs, por si thirrje p\u00ebr reflektim t\u00eb thelluar mbi drejtimin q\u00eb po merr ajo, mes synimit p\u00ebr p\u00ebrdit\u00ebsim dhe rrezikut t\u00eb hiperkodifikimit, mes politik\u00ebs dhe teknik\u00ebs ligjv\u00ebn\u00ebse. Vet\u00ebm p\u00ebrmes nj\u00eb qasjeje t\u00eb till\u00eb t\u00eb mir\u00ebmenduar mund t\u00eb sigurohet q\u00eb ndryshimet t\u00eb jen\u00eb reale, t\u00eb q\u00ebndrueshme dhe n\u00eb sh\u00ebrbim t\u00eb drejt\u00ebsis\u00eb, jo t\u00eb retorik\u00ebs s\u00eb saj.<\/p>\n<p>Zhvillimet e shpejta teknologjike dhe sociale kan\u00eb transformuar m\u00ebnyr\u00ebn se si funksionojn\u00eb marr\u00ebdh\u00ebniet shoq\u00ebrore dhe ekonomike, duke imponuar nevoj\u00ebn p\u00ebr nj\u00eb kuad\u00ebr ligjor dinamik q\u00eb pasqyron realitetet e reja. N\u00eb nj\u00eb shtet t\u00eb s\u00eb drejt\u00ebs, ligji duhet t\u00eb evoluoj\u00eb me koh\u00ebn p\u00ebr t\u00eb garantuar rendin juridik dhe mbrojtjen efektive t\u00eb t\u00eb drejtave dhe lirive t\u00eb individit, por pa cenuar sigurin\u00eb juridike dhe strukturat e normave t\u00eb konsoliduara.<\/p>\n<p>Pa hyr\u00eb n\u00eb debatin n\u00ebse \u00ebsht\u00eb apo jo e domosdoshme hartimi i nj\u00eb Kodi t\u00eb Ri Penal, \u00e7\u00ebshtje mbi t\u00eb cil\u00ebn ruaj disa rezerva, vler\u00ebsoj se kodi aktual v\u00ebshtir\u00eb se mund t\u00eb cil\u00ebsohet si i pap\u00ebrshtatsh\u00ebm n\u00eb t\u00ebr\u00ebsi. Megjithat\u00eb, ai mund t\u00eb k\u00ebrkoj\u00eb her\u00eb pas here nd\u00ebrhyrje t\u00eb pjesshme apo p\u00ebrmir\u00ebsime t\u00eb caktuara, ashtu si\u00e7 ka ndodhur jo rrall\u00eb  edhe m\u00eb par\u00eb. Kjo qasje p\u00ebrb\u00ebn n\u00eb vetvete thelbin e sistemit kontinental t\u00eb s\u00eb drejt\u00ebs, i cili bazohet n\u00eb pasurimin dhe p\u00ebrsosjen e vazhdueshme t\u00eb dispozitave ligjore. Nd\u00ebrkoh\u00eb, nga ana tjet\u00ebr, iniciativa p\u00ebr hartimin e nj\u00eb kodi t\u00eb ri n\u00eb vetvete nuk mund t\u00eb rr\u00ebzohet apriori, por, p\u00ebr t\u00eb dal\u00eb n\u00eb k\u00ebt\u00eb konkluzion, s\u00eb pari duhet analizuar nj\u00eb s\u00ebr\u00eb shkaqesh t\u00eb r\u00ebnd\u00ebsishme q\u00eb e b\u00ebjn\u00eb t\u00eb mundur arritjen n\u00eb p\u00ebrfundimin se \u00ebsht\u00eb i nevojsh\u00ebm nj\u00eb kod i ri.<\/p>\n<p>S\u00eb dyti, vler\u00ebsoj se kalimi nga nj\u00eb metodologji dhe teknik\u00eb legjislative e konsoliduar prej 100 vjet\u00ebsh (q\u00eb nga Kodi Penal i Mbret\u00ebris\u00eb Shqiptare), me nj\u00eb manual kodifikues prej rreth 400-500 nenesh, drejt nj\u00eb drafti t\u00eb p\u00ebrb\u00ebr\u00eb nga fragmente t\u00eb mbledhura nga disa vende, pa pasur nj\u00eb bosht t\u00eb qart\u00eb t\u00eb bazuar n\u00eb stadin e zhvillimit shoq\u00ebror, mentalitetin, traditat, zakonet dhe tendenc\u00ebn e dekriminalizimit t\u00eb sa m\u00eb shum\u00eb sjelljeve shoq\u00ebrore t\u00eb d\u00ebnuara, p\u00ebrb\u00ebn nj\u00eb qasje t\u00eb gabuar. Nj\u00eb draft me rreth 1000 nene t\u00eb karakterit teorik, komentues apo shterues, do t\u00eb ngurt\u00ebsoj\u00eb dhe v\u00ebshtir\u00ebsoj\u00eb vendimmarrjen e magjistrat\u00ebve dhe aplikimin e normave. P\u00ebrpjekja p\u00ebr t\u00eb shpjeguar dhe p\u00ebr ti dh\u00ebn\u00eb karakter komentues \u00e7do norme penale, duke prezumuar q\u00ebllimin e mir\u00eb p\u00ebr t\u00eb qart\u00ebsuar aplikimin e norm\u00ebs, \u00ebsht\u00eb e destinuar t\u00eb d\u00ebshtoj\u00eb madje sjell efekt t\u00eb kund\u00ebrt. Kodi Penal nuk \u00ebsht\u00eb dhe nuk mund t\u00eb jet\u00eb nj\u00eb p\u00ebrmbledhje e normave ezauruese, as nuk \u00ebsht\u00eb komentar apo udh\u00ebzues i aplikimit t\u00eb normave penale, ndaj t\u2019ju lem\u00eb magjistrat\u00ebve diskrecionin e nevojsh\u00ebm p\u00ebr aplikimin e Kodit Penal, si dhe t\u2019ju l\u00ebm\u00eb komentarin pedagog\u00ebve dhe studiueseve.<\/p>\n<p>Kjo krijon p\u00ebrshtypjen e nj\u00eb zelli t\u00eb nxituar, t\u00eb pastudiuar mir\u00eb dhe, si rrjedhim, t\u00eb pap\u00ebrshtatsh\u00ebm me Shqip\u00ebrin\u00eb e sotme dhe at\u00eb t\u00eb pakt\u00ebn p\u00ebr 30 vitet e ardhshme. Rrota \u00ebsht\u00eb shpikur; ne duhet ta p\u00ebrshtatim p\u00ebr epok\u00ebn aktuale, mbase thjesht\u00eb duke aplikuar nj\u00eb model t\u00eb vet\u00ebm (gjerman, italian apo francez), t\u00eb p\u00ebrshtatur me kushtet dhe rrethanat shqiptare. Nj\u00eb analiz\u00eb e till\u00eb nuk mund t\u00eb b\u00ebhet nga organet politike, aq m\u00eb pak nga apendikset e tyre, por nga profesionist\u00eb t\u00eb fush\u00ebs, profesor\u00eb t\u00eb s\u00eb drejt\u00ebs, vendas dhe t\u00eb huaj, katedra t\u00eb pavarura nga d\u00ebshirat momentale apo nga synime politike pra, nga ekspert\u00eb penalist\u00eb me ekspertiz\u00eb, pavar\u00ebsi dhe integritet, pavar\u00ebsisht se, n\u00eb thelb, nevojitet vullneti politik p\u00ebr ta materializuar n\u00eb nj\u00eb ligj konkret. Kjo synohet p\u00ebr nj\u00eb Kod Penal q\u00eb t\u00eb q\u00ebndroj\u00eb p\u00ebr disa dekada, por gjithsesi dinamik dhe i preksh\u00ebm her\u00eb pas her\u00eb ashtu sikund\u00ebr edhe kushtetutat nuk jan\u00eb t\u00eb paprekshme edhe pse jan\u00eb aktet m\u00eb t\u00eb larta juridike.<\/p>\n<p>Gjithsesi, synimi i k\u00ebtij shkrimi \u00ebsht\u00eb q\u00eb, duke marr\u00eb parasysh se ekziston nj\u00eb vullnet i qart\u00eb politik p\u00ebr nj\u00eb kod t\u00eb ri (i drejt\u00eb apo i gabuar si vendim mbetet p\u00ebr t\u2019u par\u00eb), t\u00eb jap disa ide lidhur me problemet e r\u00ebnda konceptuale dhe p\u00ebrmbajt\u00ebsore q\u00eb ka ky draft i paraqitur p\u00ebr publikun nga grupi i pun\u00ebs, ndon\u00ebse nuk ka nj\u00eb transparenc\u00eb t\u00eb plot\u00eb mbi at\u00eb se kush ka punuar teknikisht p\u00ebr k\u00ebt\u00eb draft, seksione t\u00eb caktuara t\u00eb tij dhe kush jan\u00eb ata q\u00eb po e propozojn\u00eb.<\/p>\n<p>Duke e konsideruar me r\u00ebnd\u00ebsi t\u00eb ve\u00e7ant\u00eb pjes\u00ebmarrjen n\u00eb diskutime rreth Draft Kodit t\u00eb Ri Penal, p\u00ebr sa i p\u00ebrket Kreut II, Veprat penale n\u00eb fush\u00ebn doganore (nenet 611\u2013626), paraprakisht po parashtroj disa mendime, t\u00eb cilat, n\u00ebse gjenden me vend, do t\u00eb sh\u00ebrbenin gjat\u00eb diskutimeve m\u00eb t\u00eb thelluara n\u00eb kuadrin e ndryshimit apo rihartimit t\u00eb Kodit t\u00eb Penal.<\/p>\n<p>Rishikimi i p\u00ebrgjithsh\u00ebm i dispozitave p\u00ebr veprat penale t\u00eb kontraband\u00ebs n\u00eb Kodin e Ri Penal \u00ebsht\u00eb nj\u00eb proces i r\u00ebnd\u00ebsish\u00ebm dhe i nd\u00ebrlikuar q\u00eb lidhet ngusht\u00eb jo vet\u00ebm me interesat financiare t\u00eb vendit dhe t\u00eb subjekteve pjes\u00ebmarr\u00ebse gjat\u00eb veprimtaris\u00eb doganore, por edhe me sigurin\u00eb dhe mbrojtjen e jet\u00ebs s\u00eb njer\u00ebzve, kafsh\u00ebve, bim\u00ebve dhe mjedisit n\u00eb t\u00ebr\u00ebsi.<\/p>\n<p>Nga ana tjet\u00ebr, \u00ebsht\u00eb fakt dhe k\u00ebt\u00eb e kemi theksuar edhe m\u00eb par\u00eb  se problemet e trajtuara lidhur me veprat penale t\u00eb kontraband\u00ebs kan\u00eb treguar qart\u00eb e n\u00eb m\u00ebnyr\u00eb t\u00eb plot\u00eb se, si nd\u00ebrmjet studiuesve, jurist\u00ebve, ashtu edhe te ligjv\u00ebn\u00ebsi, nuk ndahen mendime t\u00eb nj\u00ebjta dhe, p\u00ebr m\u00eb tep\u00ebr, nuk ekziston i nj\u00ebjti afrim kur b\u00ebhet fjal\u00eb p\u00ebr kualifikimin e krimeve t\u00eb fush\u00ebs doganore, p\u00ebr p\u00ebrmasat apo shkall\u00ebn e p\u00ebrfshirjes n\u00eb ligjin penal dhe n\u00eb Kodin Doganor (aktualisht n\u00eb Kodin Doganor n\u00eb nenet 251, 66, 67 dhe n\u00eb Kodin Penal n\u00eb fuqi, nene 171\u2013179\/c), sanksionimet q\u00eb duhet t\u00eb aplikohen, dallimin e tyre nga kund\u00ebrvajtja doganore, si dhe p\u00ebr p\u00ebrgjegj\u00ebsin\u00eb penale t\u00eb personave p\u00ebrgjegj\u00ebs.<\/p>\n<p>Ekzistenca e mendimeve dhe e pik\u00ebpamjeve t\u00eb ndryshme ka \u00e7uar dhe \u00e7on, n\u00eb m\u00ebnyr\u00eb t\u00eb paevitueshme, n\u00eb vler\u00ebsime jo t\u00eb nj\u00ebjta nga akuza, avokat\u00ebt dhe praktika gjyq\u00ebsore. Kjo e fundit, n\u00eb raste t\u00eb caktuara, ka rezultuar n\u00eb shkelje t\u00eb t\u00eb drejtave dhe interesave t\u00eb personave fizik\u00eb e juridik\u00eb, ashtu edhe t\u00eb interesave t\u00eb shtetit.<\/p>\n<p>Nga ana tjet\u00ebr, ana objektive e t\u00eb dy shkeljeve, kontraband\u00eb dhe kund\u00ebrvajtje kryesisht ndryshon vet\u00ebm n\u00eb an\u00ebn sasiore (tejkalim t\u00eb nj\u00eb pragu monetar), ndaj, krahas rihartimit t\u00eb dispozitave p\u00ebr vepr\u00ebn penale t\u00eb kontraband\u00ebs, do t\u00eb duhet t\u00eb rregullohen edhe dispozitat p\u00ebrkat\u00ebse (nenet 266\u2013272 t\u00eb Kodit Doganor).<\/p>\n<p>Mosangazhimi n\u00eb zgjidhjen e k\u00ebtyre \u00e7\u00ebshtjeve, anashkalimi i tyre edhe n\u00eb kushtet kur Kodi Doganor 2014, (me p\u00ebrjashtim t\u00eb \u00e7\u00ebshtjeve q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me bashkimin doganor t\u00eb vendeve t\u00eb Unionit), \u00ebsht\u00eb n\u00eb qasje t\u00eb plot\u00eb me UCC, ka ndikuar ndjesh\u00ebm n\u00eb hartimin e draft-Kodit t\u00eb Ri Penal dhe n\u00eb angazhimet n\u00eb kuadrin e MSA-s\u00eb p\u00ebr t\u00eb p\u00ebrafruar legjislacionin penal p\u00ebr veprat penale t\u00eb kontraband\u00ebs me Acquis Communautaire, me objektivat p\u00ebr nj\u00ebsimin me t\u00eb drejt\u00ebn doganore dhe penale e t\u00eb doktrin\u00ebs s\u00eb saj, si dhe me zbatimin sipas standardeve t\u00eb Gjykat\u00ebs Evropiane.<\/p>\n<p>Ndaj, \u00ebsht\u00eb m\u00ebse e domosdoshme q\u00eb trajtimet, ve\u00e7an\u00ebrisht p\u00ebr veprat penale t\u00eb kontraband\u00ebs, t\u00eb b\u00ebheshin me p\u00ebrgjegj\u00ebsi e seriozitet dhe me angazhimin e specialist\u00ebve t\u00eb kualifikuar t\u00eb fush\u00ebs doganore, duke ia n\u00ebnshtruar dispozitat ligjore t\u00eb shkeljeve doganore paraprakisht nj\u00eb diskutimi konstruktiv nga nj\u00eb rreth sa m\u00eb i gjer\u00eb personash t\u00eb fush\u00ebs akademike n\u00eb t\u00eb drejt\u00ebn penale doganore, t\u00eb prokuror\u00ebve, avokat\u00ebve e gjyq\u00ebsorit. Nd\u00ebrkoh\u00eb q\u00eb n\u00eb trup\u00ebn e stafit p\u00ebr hartimin e dispozitave t\u00eb kontraband\u00ebs do t\u00eb duhej t\u00eb ishte p\u00ebrfshir\u00eb edhe nj\u00eb ekspert i fush\u00ebs doganore p\u00ebr luft\u00ebn kund\u00ebr shkeljeve doganore, gj\u00eb q\u00eb do t\u00eb p\u00ebrb\u00ebnte investimin m\u00eb t\u00eb r\u00ebnd\u00ebsish\u00ebm dhe m\u00eb efikas n\u00eb p\u00ebrballjen me sfidat q\u00eb paraqet nj\u00eb nd\u00ebrmarrje e till\u00eb.<\/p>\n<p>Mendimi se prezantimi i draft-Kodit t\u00eb Ri Penal, t\u00eb hartuar nga grupi i ekspert\u00ebve t\u00eb ngarkuar nga Qeveria Shqiptare, p\u00ebrmes nj\u00eb konsultimi publik dhe m\u00eb tej parlamentar, do t\u00eb sjell\u00eb ndryshimet dhe plot\u00ebsimet e nevojshme, nuk q\u00ebndron edhe p\u00ebr faktin se nj\u00eb nd\u00ebrtim me themele t\u00eb dob\u00ebta, sado p\u00ebrmir\u00ebsime t\u2019i b\u00ebhen, \u00ebsht\u00eb i destinuar t\u00eb rr\u00ebzohet pa mund\u00ebsuar ndryshime rr\u00ebnj\u00ebsore. Ndaj \u00e7do p\u00ebrpjekje p\u00ebr korrigjime apo plot\u00ebsime t\u00eb dispozitave, si\u00e7 edhe po procedohet, nuk do t\u00eb ket\u00eb efektivitetin e duhur. P\u00ebr m\u00eb tep\u00ebr, si\u00e7 edhe \u00ebsht\u00eb theksuar nga studiues e praktikant\u00eb t\u00eb fush\u00ebs, nuk do t\u00eb p\u00ebrfaq\u00ebsoj\u00eb m\u00eb shum\u00eb se nj\u00eb nd\u00ebrmarrje t\u00eb nxituar p\u00ebr garantimin e nj\u00eb p\u00ebrafrimi t\u00eb thelluar t\u00eb dispozitave t\u00eb veprave penale t\u00eb kontraband\u00ebs me ato t\u00eb legjislacionit t\u00eb vendeve t\u00eb BE-s\u00eb. Nd\u00ebrkoh\u00eb q\u00eb produkti i k\u00ebtij drafti t\u00eb \u201cp\u00ebrmir\u00ebsuar\u201d do t\u00eb sillte m\u00eb shum\u00eb paqart\u00ebsi n\u00eb organin e luft\u00ebs kund\u00ebr kontraband\u00ebs n\u00eb DPD, n\u00eb prokuror\u00eb, n\u00eb aplikimin e dispozitave p\u00ebr shkeljet doganore dhe, si\u00e7 ka ndodhur edhe m\u00eb par\u00eb, do t\u00eb krijonte premisa p\u00ebr interpretime t\u00ebr\u00ebsisht t\u00eb ndryshme t\u00eb tyre n\u00eb raste t\u00eb ngjashme.<\/p>\n<p>&nbsp;<\/p>\n<p>P\u00ebrfshirja e veprave t\u00eb kontraband\u00ebs dhe sanksionet n\u00eb Kodin Penal k\u00ebrkon q\u00eb strukturimi i dispozitave t\u2019i p\u00ebrgjigjet Kodit Penal dhe jo t\u00eb trajtohet si nj\u00eb ligj i ve\u00e7ant\u00eb. K\u00ebshtu, n\u00eb draftin objekt diskutimi jan\u00eb parashikuar dispozita t\u00eb panevojshme (neni 611 \u2013 P\u00ebrkufizime dhe oportuniteti i Autoritetit Doganor). P\u00ebr m\u00eb tep\u00ebr, p\u00ebrkufizimet e p\u00ebrcaktuara kryesisht n\u00eb nenin 6 t\u00eb Kodit Doganor duhet t\u00eb sh\u00ebrbenin edhe n\u00eb dispozitat p\u00ebr veprat penale t\u00eb kontraband\u00ebs n\u00eb draft-Kodin Penal. Ndryshe, mund t\u00eb lindin paqart\u00ebsi dhe interpretime t\u00eb ndryshme si nga autoriteti doganor, ashtu edhe nga organi i prokuroris\u00eb dhe gjykatat.<\/p>\n<p>N\u00eb draftin objekt diskutimi jan\u00eb p\u00ebrdorur terma t\u00eb panevojsh\u00ebm, p\u00ebrs\u00ebritje t\u00eb panevojshme dhe formulime t\u00eb paqarta, t\u00eb cilat jo vet\u00ebm q\u00eb nuk mund t\u00eb pranohen n\u00eb rastin e nj\u00eb ligji me r\u00ebnd\u00ebsi t\u00eb ve\u00e7ant\u00eb, si\u00e7 \u00ebsht\u00eb Kodi Penal, por edhe mund t\u00eb b\u00ebhen shkak p\u00ebr keqinterpretime t\u00eb vet\u00eb dispozit\u00ebs ligjore. K\u00ebshtu, n\u00eb nenin 611, pika 4: \u201c...Autoriteti Doganor ushtron oportunitetin p\u00ebr t\u00eb k\u00ebrkuar...\u201d; shkronja d, pika 5: \u201cVler\u00ebsohet me objektivitet q\u00eb rasti ka r\u00ebnd\u00ebsi t\u00eb posa\u00e7me publike p\u00ebrgjith\u00ebsisht...\u201d; pika 2 e nenit 612: \u201cHedhja p\u00ebr konsum n\u00eb territorin e produkteve...\u201d; n\u00eb nenin 625, pika 2: \u201c...gjykata...publikimi i vendimit gjyq\u00ebsor.\u201d Nd\u00ebrkoh\u00eb, \u00ebsht\u00eb e nevojshme q\u00eb n\u00eb shum\u00eb dispozita t\u00eb kontraband\u00ebs t\u00eb theksohet ana subjektive \u2013 dashja.<\/p>\n<p>N\u00eb pik\u00ebn 5, shkronja \u201cd\u201d, lidhur me vler\u00ebsimin doganor apo mallrat e kaluar kontraband\u00eb, \u00ebsht\u00eb p\u00ebrcaktuar vet\u00ebm si t\u00eb rrezikshme p\u00ebr jet\u00ebn apo sh\u00ebndetin e njer\u00ebzve, kur n\u00eb fakt, n\u00eb ligjin doganor, rrezikshm\u00ebria p\u00ebrfshin jo vet\u00ebm jet\u00ebn dhe sh\u00ebndetin e njer\u00ebzve, por edhe t\u00eb kafsh\u00ebve, bim\u00ebve dhe mjedisit n\u00eb t\u00ebr\u00ebsi.<\/p>\n<p>N\u00eb pik\u00ebn 6, \u00ebsht\u00eb parashikuar si rast i ve\u00e7ant\u00eb fillimi kryesisht i hetimit penal, kur kjo \u00ebsht\u00eb detyr\u00eb dhe kompetenc\u00eb e organit t\u00eb ndjekjes penale e sanksionuar me ligj, etj.<\/p>\n<p>N\u00eb pik\u00ebn 5, shkronja a-d, togfjal\u00ebshi \u201ctarif\u00eb e shmangur n\u00eb vler\u00eb t\u00eb konsiderueshme\u201d mund t\u00eb krijoj\u00eb paqart\u00ebsi dhe keqinterpretime, kur n\u00eb Kodin Doganor, neni 6, \u00ebsht\u00eb p\u00ebrcaktuar termi \u201cdetyrime doganore t\u00eb importit\/eksportit\u201d.<\/p>\n<p>Terminologjia n\u00eb formulimin e dispozitave t\u00eb vepr\u00ebs penale t\u00eb kontraband\u00ebs n\u00eb draftin objekt diskutimi, n\u00eb t\u00eb shumt\u00ebn e rasteve, \u00ebsht\u00eb e paqart\u00eb, ndryshe nga ajo e Kodit Doganor (neni 250, 266) dhe dispozitat n\u00eb fuqi p\u00ebr kontraband\u00ebn n\u00eb Kodin Penal, t\u00eb cilat, p\u00ebr hir t\u00eb s\u00eb v\u00ebrtet\u00ebs, jan\u00eb m\u00eb t\u00eb qarta dhe m\u00eb t\u00eb kuptueshme.<\/p>\n<p>N\u00eb k\u00ebto rrethana, duke qen\u00eb se kemi t\u00eb b\u00ebjm\u00eb me nj\u00eb rast lex specialis, ku \u00e7\u00ebshtjet e kontraband\u00ebs jan\u00eb p\u00ebrcaktuar n\u00eb dispozita t\u00eb ve\u00e7anta si n\u00eb Kodin Doganor ashtu edhe n\u00eb Kodin Penal, k\u00ebrkohet nj\u00eb qart\u00ebsi dhe p\u00ebrputhje m\u00eb e mir\u00eb e termave t\u00eb p\u00ebrdorur dhe t\u00eb dispozitave q\u00eb kan\u00eb t\u00eb b\u00ebjn\u00eb me kontraband\u00ebn.<\/p>\n<p>&nbsp;<\/p>\n<p>Dispozitat p\u00ebr veprat penale t\u00eb mallrave t\u00eb ndaluara dhe t\u00eb kufizuara duhet t\u00eb ishin m\u00eb t\u00eb plota dhe t\u00eb specifikuara ve\u00e7mas, duke theksuar q\u00ebllimin e siguris\u00eb dhe mbrojtjes publike. Nd\u00ebrkoh\u00eb q\u00eb p\u00ebr vepr\u00ebn penale t\u00eb mallrave me akciz\u00eb k\u00ebrkohet nj\u00eb specifikim apo listim i mallrave me akciz\u00eb objekt kontrabande, si p.sh. p\u00ebr artikullin duhan i importuar, pije alkoolike, karburante;<\/p>\n<p>N\u00eb draft-Kodin Penal, edhe pse jan\u00eb shtuar s\u00eb tep\u00ebrmi dispozitat p\u00ebr kontraband\u00ebn, p\u00ebrcaktimet n\u00eb nenin 613 \u2013 \u201cKontraband\u00eb n\u00eb nj\u00eb regjim doganor\u201d, kufizojn\u00eb rastet e vepr\u00ebs s\u00eb kontraband\u00ebs t\u00eb cilat nuk kan\u00eb t\u00eb b\u00ebjn\u00eb me vendosjen e mallrave n\u00ebn nj\u00eb regjim doganor. Nd\u00ebrkoh\u00eb q\u00eb, duke mos b\u00ebr\u00eb formulimin e qart\u00eb p\u00ebr kontraband\u00ebn e kryer p\u00ebrmes kalimit jasht\u00eb zyrave doganore, mallrave pa deklarat\u00eb doganore apo me deklarim t\u00eb rrem\u00eb, v\u00ebshtir\u00ebsohet veprimtaria e organit t\u00eb ndjekjes penale dhe gjykat\u00ebs p\u00ebr shqyrtimin, klasifikimin dhe sanksionimin e tyre.<\/p>\n<p>N\u00eb draft-Kodin jan\u00eb shtuar llojet e veprave penale t\u00eb kontraband\u00ebs duke krijuar p\u00ebrs\u00ebritje t\u00eb panevojshme (neni 622, 619). Nd\u00ebrkoh\u00eb, formulimet e nenit 623, lidhur me mosdeklarimin e objekteve antike dhe mosp\u00ebrfshirja e tyre s\u00eb bashku me mallrat me vler\u00eb komb\u00ebtare krijojn\u00eb paqart\u00ebsi me pasoja n\u00eb veprimtarin\u00eb hetimore dhe gjyq\u00ebsore.<\/p>\n<p>Neni 626 \u2013 Konkurimi i veprave dhe bashk\u00ebpunimi \u00ebsht\u00eb i diskutuesh\u00ebm. Q\u00ebndrimi i gjykat\u00ebs dhe, n\u00eb t\u00ebr\u00ebsi, doktrina, falsifikimin deri m\u00eb sot nuk e ka konsideruar vep\u00ebr penale m\u00eb vete q\u00eb konkurron me vepr\u00ebn penale t\u00eb kontraband\u00ebs, nd\u00ebrkoh\u00eb q\u00eb ka konsideruar korrupsionin si vep\u00ebr penale q\u00eb konkurron me kontraband\u00ebn.<\/p>\n<p>Sanksionet e parashikuara n\u00eb draft-Kodin, si ato me burg ashtu edhe ato me gjob\u00eb, bien ndesh me respektimin e parimit t\u00eb r\u00ebnd\u00ebsish\u00ebm q\u00eb ato t\u00eb jen\u00eb efektive, proporcionale dhe dekurajuese, si dhe vendosjen e tyre n\u00eb kufij t\u00eb arsyesh\u00ebm. Nd\u00ebrkoh\u00eb, kjo mund t\u00eb krijoj\u00eb efekte t\u00eb pad\u00ebshiruara, p\u00ebr shkak t\u00eb nj\u00eb ashp\u00ebrsimi t\u00eb tepruar t\u00eb mekanizmave t\u00eb d\u00ebnimeve penale. Ndaj k\u00ebrkoheshin dispozita t\u00eb ve\u00e7anta p\u00ebr dekriminalizimin e veprave penale, me d\u00ebnim me gjob\u00eb n\u00eb nj\u00eb kufi t\u00eb arsyesh\u00ebm.<\/p>\n<p>K\u00ebshtu, parashikimet n\u00eb draft-Kodin e ri Penal t\u00eb d\u00ebnimeve alternative me burg edhe p\u00ebr mallrat e zakonshme (neni 620, 621\/1, 617, 618, 619) r\u00ebndojn\u00eb pozit\u00ebn e personit n\u00ebn p\u00ebrgjegj\u00ebsi penale. Kjo \u00ebsht\u00eb ve\u00e7an\u00ebrisht e dukshme n\u00eb nenin 624 t\u00eb draft-Kodit, ku p\u00ebr personat juridik\u00eb jan\u00eb parashikuar d\u00ebnime me gjob\u00eb n\u00eb mas\u00ebn e pes\u00ebfishit (n\u00eb fakt, duhet t\u00eb b\u00ebhet fjal\u00eb p\u00ebr detyrime t\u00eb shmangura apo t\u00eb munguara). Duke shtuar k\u00ebtu edhe d\u00ebnimin administrativ t\u00eb parashikuar n\u00eb nenin 268, pika 2 t\u00eb Kodit Doganor, q\u00eb \u00ebsht\u00eb trefish i detyrimit t\u00eb shmangur dhe konfiskimi i mallrave objekt kontrabande e i mjeteve t\u00eb transportit, masa represive e d\u00ebnimit i kalon \u00e7do kufi t\u00eb arsyetimit logjik!<\/p>\n<p>Nd\u00ebrkoh\u00eb q\u00eb, duke mos b\u00ebr\u00eb dallim n\u00eb sasin\u00eb, pesh\u00ebn dhe vler\u00ebn e tyre, kjo bie ndesh si me dispozitat e legjislacionit penal p\u00ebr kontraband\u00ebn n\u00eb vendet e Unionit, ashtu edhe me tendenc\u00ebn aktuale p\u00ebr dekriminalizim t\u00eb disa veprave penale t\u00eb kontraband\u00ebs.<\/p>\n<p>Nga ky k\u00ebndv\u00ebshtrim, nj\u00eb analiz\u00eb m\u00eb e kujdesshme k\u00ebrkohet edhe lidhur me p\u00ebrfshirjen e personit n\u00ebn hetim p\u00ebr sa i p\u00ebrket shmangies nga pagesa e shum\u00ebs s\u00eb TVSH-s\u00eb. \u00cbsht\u00eb e qart\u00eb se momenti doganor i importimit p\u00ebrb\u00ebn lindjen e detyrimit doganor (ose faktin gjenerues), por p\u00ebr rastin e detyrimit t\u00eb TVSH-s\u00eb ai realizohet plot\u00ebsisht vet\u00ebm me futjen n\u00eb konsum t\u00eb produktit. Dhe kjo \u00ebsht\u00eb e vet\u00ebkuptueshme, ashtu si\u00e7 p\u00ebrmendet edhe n\u00eb ligjin p\u00ebr TVSH-n\u00eb, kemi t\u00eb b\u00ebjm\u00eb me furnizim. Ndaj ky problem duhet t\u00eb ishte analizuar me v\u00ebmendjen e duhur, pasi p\u00ebrfshirja p\u00ebrfundimtare e TVSH-s\u00eb n\u00eb detyrimet e importit mund t\u00eb ket\u00eb efekte t\u00eb pad\u00ebshiruara, p\u00ebr shkak t\u00eb nj\u00eb ashp\u00ebrsimi t\u00eb tepruar t\u00eb mekanizmave t\u00eb d\u00ebnimeve penale, pa nj\u00eb vler\u00ebsim t\u00eb duhur t\u00eb natyr\u00ebs s\u00eb detyrimit t\u00eb shmangur q\u00eb ka t\u00eb b\u00ebj\u00eb si me mallrat objekt konfiskimi, ashtu edhe me pages\u00ebn e TVSH-s\u00eb s\u00eb shmangur.<\/p>\n<p>P\u00ebr m\u00eb tep\u00ebr, qasja n\u00eb dispozitat e draft-Kodit Penal q\u00eb bazohet n\u00eb zgjerimin e rasteve q\u00eb identifikohen si kontraband\u00eb (d.m.th. shkelje penale mbi 10 mij\u00eb euro), rrezikon t\u00eb krijoj\u00eb nj\u00eb situat\u00eb t\u00eb pajustifikuar lidhur me shmangien nga pagesa e TVSH-s\u00eb, pasi mund t\u00eb hap\u00eb procedura penale edhe p\u00ebr raste t\u00eb r\u00ebnd\u00ebsis\u00eb s\u00eb vog\u00ebl, t\u00eb cilat, n\u00eb shumic\u00ebn e rasteve, p\u00ebrfundojn\u00eb duke shkaktuar konsumim t\u00eb kot\u00eb t\u00eb energjive t\u00eb autoriteteve dhe pasoja operative e financiare p\u00ebr bizneset.<\/p>\n<p>Parashikimi n\u00eb draft-Kodin Penal i konfiskimit t\u00eb mjeteve t\u00eb transportit n\u00eb \u00e7do rast, si dhe mosp\u00ebrfshirja e alternativ\u00ebs kur mungon malli p\u00ebr konfiskimin n\u00eb vler\u00eb t\u00eb tij, k\u00ebrkon sakt\u00ebsime t\u00eb m\u00ebtejshme lidhur me pranin\u00eb e mjetit t\u00eb transportit dhe kur mjeti \u00ebsht\u00eb p\u00ebrgatitur posa\u00e7\u00ebrisht p\u00ebr fshehjen e mallit, modifikuar p\u00ebr t\u00eb rritur kapacitetin e ngarkes\u00ebs ose autonomin\u00eb, ose q\u00eb p\u00ebrdoret n\u00eb shkelje t\u00eb rregullave q\u00eb lidhen me qarkullimin e mjeteve motorike dhe sigurin\u00eb detare.<\/p>\n<p>Draft-Kodi n\u00eb nenin 624, pika 2, 3 dhe neni 625, duke huazuar nga pjesa e p\u00ebrgjithshme e Kodit Penal n\u00eb fuqi, ka parashikuar edhe q\u00ebndrimin e gjykat\u00ebs lidhur me d\u00ebnimet dhe masat plot\u00ebsuese.<\/p>\n<p>N\u00ebse do t\u00eb p\u00ebrfshihen n\u00eb k\u00ebt\u00eb paket\u00eb t\u00eb dispozitave p\u00ebr kontraband\u00ebn edhe procedura dhe vendimmarrja e gjykat\u00ebs, at\u00ebher\u00eb do t\u00eb duhet t\u00eb zgjerohet m\u00eb tej veprimtaria e gjykat\u00ebs lidhur me rastet e pushimit t\u00eb gjykimit t\u00eb \u00e7\u00ebshtjes p\u00ebr kontraband\u00eb dhe d\u00ebrgimi i saj p\u00ebr procedim administrativ, etj., gj\u00eb q\u00eb do ta r\u00ebndonte s\u00eb tep\u00ebrmi k\u00ebt\u00eb dispozit\u00eb, e cila mund t\u00eb p\u00ebrfshihej n\u00eb Kodin Doganor, p\u00ebrfshir\u00eb trajtimin e mallrave t\u00eb konfiskuara, etj.<\/p>\n<p>Neni 619 k\u00ebrkon ristrukturim. Por edhe nga k\u00ebndv\u00ebshtrimi formal, kjo dispozit\u00eb ka pasakt\u00ebsi. Evolucioni i shpejt\u00eb i fenomeneve kriminale, ve\u00e7an\u00ebrisht atyre q\u00eb lidhen me krimin kibernetik, korrupsionin, taksat, mbrojtjen e t\u00eb miturve dhe mjedisin, k\u00ebrkon nj\u00eb reagim ligjor t\u00eb studiuar, t\u00eb qart\u00eb dhe efektiv. P\u00ebrshtatja e dispozitave penale me k\u00ebto zhvillime nuk p\u00ebrb\u00ebn vet\u00ebm nj\u00eb domosdoshm\u00ebri praktike, por edhe nj\u00eb detyrim q\u00eb buron nga parimet themelore t\u00eb shtetit t\u00eb s\u00eb drejt\u00ebs dhe nga procesi i integrimit evropian.
